ENGINEER'S TESTIMONY THAT SEAT BELT'S ABILITY TO PARTIALY LATCH WAS DANGEROUS WAS ADMISSIBLE

In Nemir v. Mitsubishi Motors Corp., the United States District Court, E.D. Michigan ruled that an automotive safety engineer's testimony that seat belt buckle's ability to latch under any method created an unreasonably dangerous product was admissible in products liability suit against automobile manufacturer. However, based on his general testimony that partial latching of the seat belt may occur, the engineer could not testify that partial latching was the sole cause of the plaintiff's injuries.
